IMPORTANT-READ CAREFULLY: This License Agreement is a legal Agreement between you, the Developer End User, and Osen Kusnadi for OsenXPSuite ActiveX Control, the Software Product.

By installing, copying, or otherwise using and testing the Software Product, you agree to be bound by the terms of this agreement. If you do not agree to the terms of this agreement, do not install or use the Software Product.

Any reproduction or redistribution of the Software Product or any its component not in accordance with the License Agreement is expressly prohibited by law, and may result in severe civil and criminal penalties.

The Software Product is licensed on a per-developer basis, one license is required for each development computer on which The Software Product is installed.

There are 3 basic types of licenses issued for the Software Product, these are:

1. Evaluation License
   The Developer End User is granted a License for a period of only thirty (30) days after installation of the evaluation version of the Software Product. After this evaluation period, the Developer End User shall either (i) delete the Software Product and all related documentation from all computers onto which it was installed or copied, or (ii) contact Osen Kusnadi or one of its authorized resellers to purchase the Software Product. The Developer End User may use the evaluation version of the Software Product for evaluation purposes only.
   


2. Developer License
   Allows to use The Software Product by one developer in one computer. Developer Licenses are non-transferable between developers, but You may physically transfer the Software Product from one computer to another provided that the Software License is only installed and used on one computer at a time.
   


3. Site License (Unlimited Developer Licenses)
   Allows to use The Software Product by any developers of one company at a single physical address in any development environment.

Your rights and obligations with respect to the use of The Software Product or any its component is as follows:

YOU MAY:

1. Use The Software Product in design on as many computers as the license, that you have purchased.
2. Create commercial applications based on The Software Product and distribute them with your executables, no royalties required.
3. You can create as many applications as you want.
4. You may make copies of the Software and Software License for backup purposes
5. Receive support by e-mail to answer questions and solve problems referred to the control.

YOU MAY NOT:
Use, copy, emulate, clone, rent, lease, sell, modify, decompile, disassemble, otherwise reverse engineer, or transfer the licensed program, or any subset of the licensed program, except as provided for in this agreement. Any such unauthorized use shall result in immediate and automatic termination of this license and may result in criminal and/or civil prosecution.

ROYALTIES
The Software Product is royalty free. End-user applications that have been developed with the Software Product may be distributed in an unlimited number, without paying any license fees whatseover.

REDISTRIBUTABLE FILES
Redistributable components are those files specifically designated as being distributable in the 'Distributing your Applications' section.

NO WARRANTIES.
Osen Kusnadi expressly disclaims any warranty for the Software Product.

The Software Product AND ANY RELATED DOCUMENTATION IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OR MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT.

THE ENTIRE RISK ARISING OUT OF USE OR PERFORMANCE OF The Software Product REMAINS WITH YOU.

NO LIABILITY FOR CONSEQUENTIAL DAMAGES.
IN NO EVENT SHALL Osen Kusnadi BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OR OF INABILITY TO the Software Product.

ACKNOWLEDGEMENTS
You acknowledge that you have read this Agreement, understand it, and agree to be bound by its terms and conditions.
